These Terms of Use (“Terms”) govern your access to and use of Night & Thermal Vision Camera (the “App”), operated by Night & Thermal Vision Camera (“we,” “us,” or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Eligibility
You must be at least 13 years old, or the minimum age required in your country, to use the App.
If you are under the age of majority in your jurisdiction, you may use the App only with the consent and supervision of a parent or legal guardian.
License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App for personal, non-commercial purposes.
You may not:
- copy, reproduce, distribute, or resell the App;
- modify, adapt, or create derivative works based on the App;
- reverse engineer, decompile, or attempt to access the App’s source code except where permitted by applicable law;
- interfere with or disrupt the operation of the App;
- use the App for any unlawful purpose.
App Features
The App provides camera-based visual effects and media processing features.
You are solely responsible for how you use any photos, videos, or other content created, imported, edited, saved, or shared through the App.
You agree to use the App in compliance with all applicable laws and regulations.
User Content
The App may allow you to create, import, edit, save, and share photos, videos, and other content (“User Content”).
You retain ownership of your User Content.
You represent and warrant that:
- you own or have the necessary rights to use any User Content;
- your User Content does not violate any law or third-party rights;
- your use of the App does not infringe intellectual property, privacy, publicity, or other legal rights.
Prohibited Conduct
You agree not to:
- violate any applicable law or regulation;
- use the App to harass, abuse, threaten, or harm others;
- infringe intellectual property or privacy rights;
- distribute malicious software, viruses, or harmful code;
- attempt unauthorized access to the App or related systems;
- interfere with the operation, security, or stability of the App.
Subscriptions and In-App Purchases
Certain features may require a paid subscription or in-app purchase.
If you purchase a subscription:
- payment will be charged to your Apple ID account upon confirmation of purchase;
- subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period;
- your account will be charged for renewal within 24 hours before the end of the current billing period;
- subscriptions may be managed or canceled through your Apple account settings.
All payments, billing, and refunds are handled by Apple under its applicable terms and policies.
Intellectual Property
The App, including its software, design, user interface, graphics, logos, trademarks, text, and other content provided by us, is owned by or licensed to us and protected by applicable intellectual property laws.
These Terms do not grant you ownership of the App or any of our intellectual property rights.
Privacy
Your use of the App is also governed by our Privacy Policy.
By using the App, you acknowledge that you have read and understood our Privacy Policy.
Third-Party Services
The App may use third-party services, including Apple App Store, RevenueCat, Firebase Analytics, and Firebase Crashlytics.
Your use of such services may also be subject to their own terms and privacy policies.
If you downloaded the App through the Apple App Store, you acknowledge that:
- these Terms are between you and us, not Apple;
- Apple is not responsible for the App or its content;
- Apple has no obligation to provide maintenance or support services for the App except as required by applicable law.
Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
We do not guarantee that:
- the App will operate without interruption or error;
- defects will be corrected;
- the App will be compatible with all devices or software configurations;
- the App will always be available or secure.
Your use of the App is at your own risk.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the App.
Our total liability for any claim relating to the App shall not exceed the amount paid by you for subscriptions or purchases made through the App during the twelve (12) months preceding the event giving rise to the claim, or EUR 50 if no payment was made, whichever is greater.
Indemnification
You agree to indemnify and hold harmless us, our affiliates, contractors, partners, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from:
- your use of the App;
- your User Content;
- your violation of these Terms;
- your violation of any law or third-party rights.
Suspension and Termination
We may suspend or terminate access to the App at any time if we reasonably believe that you have violated these Terms or if required by law.
Upon termination, all rights granted under these Terms will immediately cease.
Changes to the App and Terms
We may modify, update, suspend, or discontinue the App or any part of it at any time.
We may also update these Terms from time to time. When changes are made, we will revise the “Last updated” date above.
Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed and interpreted in accordance with the laws applicable in the jurisdiction of the App operator, without regard to conflict of law principles.
Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
